#DIABETESSQUAD CHALLENGE

In this Privacy Notice, Roche informs you about the processing of your personal data when you give us your consent to use your video submission for advertisement purposes as described below (“Purpose”). Controller for the processing of your personal data for the Purpose is:

(hereinafter referred to as: “we”, “us” or „ROCHE“)

1. Purpose

For our #DiabetesSquad Challenge we call out to you to submit a video of yourself nominating your personal diabetes hero. Out of all submissions we will select specific videos or parts thereof and put together a chain video. We will post this chain video worldwide on our websites and on our social media accounts on World Diabetes Day (November 15, 2021) to celebrate and recognize diabetes heroes together with the whole diabetes community. ROCHE wishes to further utilize this chain video exclusively for the purpose of promotion and marketing purposes. This may include electronic publications, video, audio, adverts, press releases, photo galleries, news media, social media, and any other media form. Besides your submitted video, none of your personal details you submitted separately to us, including your name, will be published by ROCHE. If you provide us with your social media preference, we will use this information to analyze participant’s social media preference on an aggregated level.

2. Personal Data collected

For the Purpose, we will collect the following personal data:

  •  First and last name;
  •  Contact details: e-mail;
  •  Your video as submitted by you; and
  •  Preferred social media account (optional).

3. Purpose and Legal Basis for Processing your Personal Data

ROCHE processes your personal data exclusively for the Purpose. ROCHE will use your contact information only to contact you for the Purpose and to answer any questions you may have. The legal basis for the processing of your personal data is your consent. You may withdraw any consent you have given at any time. Withdrawing your consent does not affect the lawfulness of the processing until withdrawal. The withdrawal can be declared via e-mail to [email protected]. After withdrawal of your consent, ROCHE will no longer process your personal data unless ROCHE is legally entitled or obliged to do so. Yet, please be aware that it might not be possible for ROCHE to limit the use of the submitted video by third parties once published on the internet. If you provide any personal data of other persons in your video (such as name, image or their live appearance in your video submission), you have to make these persons aware of this privacy policy and obtain their upfront consent as required under applicable law.

4. Data Transfer

As ROCHE is a global company, for specific purposes your data may also be transferred to other companies of the Roche Group and to service providers in so-called third countries where the data protection level may not meet the European standards. The list of companies of the Roche Group is included in the current version of the Roche Group Annual Report, which is available on the website www.roche.com. Data protection outside of the EU or the European Economic Area, e.g. in the USA, where there may not be a comparable level of data protection, may be ensured by adequacy decisions of the EU Commission (as it is the case e.g. for Switzerland) or EU standard contractual clauses and, where applicable, further measures. You may obtain further information on this via the above-mentioned contact details. Please note that if the recording is published on online platforms and social networks, it can be accessed worldwide. 5. Retention Period

ROCHE will retain your personal data for the duration of any advertisement campaigns which include your video submission. Individual video submissions that are not used for creating a chain video will be deleted without undue delay after completion of the chain video. Social media preferences will be aggregated and thereby anonymized right after submission. Additionally, ROCHE will retain your personal information to prove its compliance with applicable data protection regulations and laws and for asserting or defending legal claims.

6. Your Rights

Regarding the processing of your personal data you are entitled to the rights stipulated by the applicable law (access, rectification of incorrect data, erasure, restriction of processing, data portability). If the recording is based on your consent, this consent can be withdrawn at any time for the future. This shall not affect the lawfulness of processing based on consent before its withdrawal. To exercise your data subject rights, please contact our Data Protection Officer under the contact details provided below. You also have the right to issue complaints about the processing of your personal data by ROCHE to a data protection supervisory authority, in particular in the EU Member State of your habitual residence, your place of work or the place of the alleged infringement.
